Terms of Service
Effective Date: September 26, 2026
Welcome to Fiamma. These Terms of Service (“Terms”) govern your access to and use of Fiamma, including the Fiamma website, application, and related services (collectively, the “Service”).
Fiamma is currently operated by Courtney Miller in New Mexico, United States (“Fiamma,” “we,” “us,” or “our”).
By creating an account or using Fiamma, you agree to these Terms. If you do not agree to these Terms, please do not use the Service.
1. Eligibility
You must be at least 13 years old to use Fiamma.
If you are under the age of majority where you live, you may use Fiamma only with the permission of a parent or legal guardian.
Cooking can involve knives, heat, appliances, raw ingredients, and other potential hazards. Younger users should cook with appropriate adult supervision.
2. Your Account
Some Fiamma features require an account. You agree to provide accurate information when creating your account and to keep your login credentials secure.
You are responsible for activity that occurs through your account. If you believe your account has been accessed without your permission, please contact us at hello@cookwithfiamma.com.
You may not create an account for another person without their permission or use Fiamma in a fraudulent or unlawful manner.
3. Fiamma Is Currently in Beta
Fiamma is currently offered as a free beta service.
Beta software is still being developed and tested. Features may change, malfunction, become temporarily unavailable, or be added or removed as we learn how people use Fiamma.
You may encounter bugs, incomplete features, inaccurate outputs, lost information, or other unexpected behavior during the beta period. Please do not rely on Fiamma as the sole place to store information that is important to you.
We may modify, suspend, or discontinue portions of the beta Service as development continues.
4. What Fiamma Provides
Fiamma is a cooking companion designed to help users discover recipes, explore cooking ideas, adapt dishes, organize recipes and ingredients, plan meals, and receive guidance while cooking.
Some content provided through Fiamma is generated or adapted automatically based on information you provide. This means that recipes, instructions, substitutions, quantities, cooking times, and other suggestions may occasionally contain mistakes or produce unexpected results.
Fiamma is intended to support your own judgment in the kitchen, not replace it.
5. Food Safety, Allergies, and Dietary Needs
Cooking inherently involves some risk, and every kitchen, ingredient, appliance, and individual dietary situation is different.
You are responsible for determining whether ingredients, recipes, cooking methods, and suggestions provided through Fiamma are appropriate and safe for you and the people you are cooking for.
In particular:
- Food allergies and intolerances: Even if you provide Fiamma with information about allergies, intolerances, or dietary restrictions, you should independently verify every ingredient and product label before consuming or serving food. Fiamma cannot guarantee that a recipe or suggestion will be free of a particular allergen or ingredient.
- Cross-contamination: Fiamma cannot assess how ingredients were manufactured, packaged, stored, or prepared and cannot guarantee against cross-contact or cross-contamination.
- Cooking temperatures and foodborne illness: Cooking times and temperatures can vary based on ingredients, equipment, altitude, portion size, and other conditions. Use appropriate food-safety practices and independently confirm that potentially hazardous foods have reached safe temperatures before eating or serving them.
- Ingredient substitutions: Substitutions may affect food safety, texture, flavor, cooking time, or the success of a recipe. Use reasonable judgment when making substitutions.
- Dietary preferences: While Fiamma may attempt to accommodate dietary preferences and restrictions, automatically generated recommendations may occasionally fail to reflect them correctly.
If you have a severe or life-threatening food allergy, medical dietary requirement, or other condition for which an ingredient mistake could cause serious harm, do not rely solely on Fiamma to determine whether a food or recipe is safe for you.
Fiamma does not provide medical, nutritional, or dietary treatment or diagnosis. Information provided through the Service is for general cooking and informational purposes.
6. User Content
You may be able to enter, save, upload, or create content through Fiamma, including recipes, notes, ingredient lists, preferences, feedback, photographs, or other materials (“User Content”).
You retain ownership of your User Content.
By submitting User Content to Fiamma, you give us permission to host, store, process, reproduce, and otherwise use that content as reasonably necessary to operate, maintain, improve, and provide the Service.
This permission does not transfer ownership of your User Content to us.
You are responsible for ensuring that you have the right to submit any content you provide to Fiamma. Please do not upload or submit content that violates another person's intellectual property, privacy, or other legal rights.
7. Fiamma Content and Intellectual Property
The Fiamma name, branding, design, software, interface, graphics, original written content, and other materials created for the Service are owned by Fiamma or its licensors and are protected by applicable intellectual property laws.
These Terms give you permission to use Fiamma for your personal, lawful use. They do not transfer ownership of Fiamma or its intellectual property to you.
You may use recipes and cooking suggestions generated for you through Fiamma for your own personal cooking and everyday use.
You may not copy, reproduce, scrape, reverse engineer, sell, sublicense, or commercially exploit substantial portions of the Fiamma Service, software, interface, recipe collection, branding, or proprietary content without permission.
8. Acceptable Use
You agree not to misuse Fiamma.
Among other things, you may not:
- use the Service for unlawful, fraudulent, or abusive purposes;
- attempt to gain unauthorized access to Fiamma, another user's account, or systems connected to the Service;
- intentionally interfere with or disrupt the operation or security of the Service;
- introduce malicious code, automated attacks, or other harmful technology;
- use automated systems to scrape or extract substantial amounts of content from Fiamma without permission;
- impersonate another person or misrepresent your affiliation with another person or organization; or
- use Fiamma in a manner that infringes the rights of others.
We may restrict or terminate access to the Service if we reasonably believe these Terms have been violated or if necessary to protect Fiamma, its users, or others.
9. Privacy
Your use of Fiamma is also subject to our Privacy Policy, which explains what information we collect, how we use it, and the choices available to you.
The Privacy Policy is separate from these Terms and should be reviewed before using Fiamma.
10. Future Paid Services
Fiamma is currently offered free of charge during its beta period.
We may introduce subscriptions, paid features, or other paid services in the future.
We will provide applicable pricing and payment terms before charging you. Your continued use of free beta features does not, by itself, authorize Fiamma to charge you in the future.
If paid services are introduced, additional or updated terms regarding billing, subscriptions, cancellation, refunds, and related matters may apply.
11. Disclaimers
We work to make Fiamma useful, reliable, and enjoyable, but we cannot guarantee that every recipe, recommendation, instruction, calculation, or other piece of information will be accurate or suitable for every situation.
To the extent permitted by applicable law, Fiamma is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free, or that every recipe or recommendation will produce a particular result.
Nothing in these Terms excludes warranties or other rights that cannot legally be excluded under applicable consumer-protection law.
12. Limitation of Liability
To the extent permitted by applicable law, Fiamma and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.
This includes, where permitted by law, losses resulting from reliance on inaccurate recipes or information, unsuccessful cooking results, loss of data, interruptions of the Service, or unauthorized access to an account.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
Because some jurisdictions do not allow certain limitations of liability, some of these limitations may not apply to you.
13. Your Responsibility for Misuse of the Service
If your unlawful use of Fiamma or violation of these Terms causes a third party to bring a claim against Fiamma, you agree, to the extent permitted by applicable law, to be responsible for losses or reasonable costs resulting from that claim.
This provision does not require you to compensate Fiamma for losses caused by Fiamma's own unlawful conduct, negligence, or other conduct for which liability cannot legally be shifted to you.
14. Third-Party Services
Fiamma may rely on or connect with third-party services that help us operate the Service.
Those services may be governed by their own terms and privacy practices. We are not responsible for third-party services that we do not control.
15. Changes to or Termination of the Service
Fiamma is an evolving product. We may add, change, suspend, or discontinue features or portions of the Service.
You may stop using Fiamma at any time.
We may suspend or terminate an account when reasonably necessary because of a violation of these Terms, misuse of the Service, security concerns, legal requirements, or discontinuation of the Service.
Where appropriate, we will try to provide reasonable notice of significant changes affecting users.
16. Changes to These Terms
We may update these Terms as Fiamma evolves.
If we make material changes, we will provide reasonable notice through the Service, by email, or through another appropriate method.
The updated Terms will identify their effective date. If applicable law requires your affirmative consent to a change, we will request it.
17. Governing Law
These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-law principles, except where applicable law gives you rights that cannot be waived or requires another jurisdiction's laws to apply.
Nothing in these Terms prevents you from exercising consumer rights or other legal rights available to you under applicable law.
18. General Terms
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
These Terms, together with the Privacy Policy and any additional terms that expressly apply to a particular Fiamma feature, constitute the agreement between you and Fiamma concerning your use of the Service.
